Influence of Forensic and Incriminating Evidence on Court Verdicts of Sexual Assault Trials

Abstract

Sexual violence remains a critical challenge in Kenya, with survivors often encountering systemic barriers within the criminal justice system. This study examined the progression of sexual assault cases, focusing on judicial officers’ decision-making, prosecutorial practices, and the role of forensic evidence. A mixed-methods approach was employed, including a review of case files, legal documents, and relevant literature. Findings reveal significant delays in case processing, inconsistent application of the law, and gendered biases that affect both survivors and accused persons. Forensic evidence was underutilised, and victim narratives frequently influenced judicial outcomes. The study highlights the need for targeted training for judicial officers, enhanced forensic capacity, and strengthened legal frameworks to improve case handling and ensure justice for survivors. These insights contribute to policy development and underscore the importance of a gender-sensitive and evidence-based approach to sexual assault cases.
